Declaration of Sovereignty
Vema Seamount was declared a Sovereign Territory on the first day of August 2006, by the founding father of the Vema Seamount community Mr ‘Paulo Caposso’ who to symbolize the birth of the Kingdom of Mount Vema - Vema Seamount, the new Royal Family and Monarchy, became the Vema Seamount Authority, anointed as His Majesty King Peter Jon Goldishman of Mount Vema, and who with the following declaration sealed his sovereign rights to the territory with the following statement:
“In the Course of natural and human evolution with respect for the time and space of all living things including the Earth, the Universe and the Rules of Nature, it becomes necessary for one person to take a stand and make the difference.”
“Therefore, I, Peter Jon Goldishman, hereby declare, the Seamount, named Vema 'Vema Seamount' located at 31° 38' S 8° 20' E a Sovereign Territory.”
“I hereby do solemnly swear that I will faithfully exercise the duties of Sovereign of the Vema Seamount territory, and will to the best of my ability, preserve and protect the Vema Seamount, the Vema Seamount Marine Life, the People living within the Vema Seamount Territory; and serve and protect the integrity of this Declaration and the Constitution of the Kingdom of Mount Vema – Vema Seamount.”
“For the support of this Declaration, with a firm reliance on the protection of Divine Providence, I hereby pledge my Life, my Fortunes and my sacred Honor for the welfare of Vema Seamount and consequently the World at large.”
“I also believe that all men are created equal. They are endowed by their Creator with certain unalienable Rights that among those are Life and the pursuit of Happiness. And to secure these rights, an individual has the right to follow his own destiny. Even if his destiny involves, establishing a new settlement and institute a new way of life.”
“To lay its foundation on such principles and organizing its powers in such form, as to he shall see most likely to effect the Safety and Happiness of his family and those who share the same views and values;”
“And those who believe in the preservation of nature and the planet Earth as we know it, as well as the need of the establishment of a newly formed independent state as the only way to help save large numbers of people from extreme poverty in Africa and the world, by establishing new trade routes, create new jobs, a new currency and provide for new Guards for the security of the settlement, and such is now the necessity which constrains me to form and found this Nation.”

The preamble of the declaration establishes that “whatever is written herein shall be considered final and shall be respected by the International Community.
The Vema Seamount Declaration of Sovereignty
PREAMBLE
- Within the framework of the foundation of the Kingdom of Mount Vema - Vema Seamount;
- Reaffirming its determination to promote peace, coexistence with nature, territorial integrity and security, while recognizing its legitimate rights for self-government;
- Reaffirming its desire to achieve a just, lasting and comprehensive economic settlement through this Declaration;
- Reaffirming its adherence to the recognition of other Nations and commitments expressed in this Declaration;
- Reaffirming its understanding that the Royal Family of Mount Vema, the People of Mount Vema and its self-government structure contained in this Declaration, shall be an integral part of the Vema Seamount Territory;
- Reaffirming its obligations to Earth and its responsibilities to defend and maintain the natural balance and composition of our Planet and the Universe.
- Reaffirming its determination to promote peace, coexistence with nature, territorial integrity and security, while recognizing its legitimate rights for self-government;
- Reaffirming its desire to achieve a just, lasting and comprehensive economic settlement through this Declaration;
- Reaffirming its adherence to the recognition of other Nations and commitments expressed in this Declaration;
- Reaffirming its understanding that the Royal Family of Mount Vema, the People of Mount Vema and its self-government structure contained in this Declaration, shall be an integral part of the Vema Seamount Territory;
- Reaffirming its obligations to Earth and its responsibilities to defend and maintain the natural balance and composition of our Planet and the Universe.
Hereby commits itself to the following:
Article 1: Definitions
For the purpose of this Declaration:
- The Vemans, the Vema Seamount Community or the People of Mount Vema means the legal residents of the Kingdom of Mount Vema and Citizens of the Kingdom of Mount Vema residing both in Mount Vema and abroad.
- The Vema Seamount Authority, the Sovereign of Mount Vema or the Veman Monarch means the Protector of the Realm and Head of the State of Mount Vema herein the Kingdom of Mount Vema.
- The founding father of the nation means The Vema Seamount Authority, His Majesty King Peter Jon Goldishman of Mount Vema.
- The Vema Seamount Territory means the Vema Seamount and its adjacent waters.
- The International Community means the Nations and territories of the World.
- The terms "Kingdom of Mount Vema", "State of Mount Vema" and "Mount Vema" shall include the seamount vema 'Vema Seamount' or Vema Seamount Territory at 31° 38' S 8° 20' E and its floating districts, to be named thereafter, including the statutory agencies and corporations registered in the territory.

Article 2: Vema Seamount Statehood
1. The Mount Vema Legal System shall be based on the Constitution of Mount Vema.
2. English shall be the Kingdom of Mount Vema -Vema Seamount’s official language.
3. The Monarchy of Mount Vema shall be based on hereditary principle.
4. The Kingdom of Mount Vema shall have its own great seal, currency, passport, anthem, flag and shall administer justice through its judiciary branches.

Article 3: Assumption of Authority
The Vema Seamount Authority as specified in this Declaration shall be assumed by the Head of the Mount Vema Royal Family, who shall be the Veman Sovereign. The Veman Sovereign shall be the Head of State, Supreme Ruler of the Vema Seamount Territory and the Mount Vema Nation hereby established, in accordance with this Declaration.
Article 4: Structure and Composition of the Vema Seamount Authority
1. The Authority of the Monarch - The Vema Seamount Authority shall consist of a Veman Congress or the Congress of Mount Vema. The Veman Congress shall act in the name of the Veman Sovereign and shall carry out the responsibilities for the Legislative Branch, in accordance with this Declaration.
2. The Monarchy of Mount Vema shall oversee the departments established or to be established within the Mount Vema jurisdiction, other departments and subordinate administrative units as necessary for the fulfilment of the Nation’s missions, objectives and responsibilities, and shall determine the Mount Vema Community own internal procedures.
3. The Royal Palace of Mount Vema, which shall be the name of the official residence and work place of the Veman Sovereign, shall make public the names of the members of the Veman Congress, other Officials and any change of Mount Vema Government officials.
4. Each member of the Veman Congress shall enter into office upon undertaking an oath of loyalty to the Veman Sovereign, the Constitution of the State and to act in accordance with this Declaration.

Article 5: Jurisdiction
1. The Authority of the Veman Sovereign shall encompass all matters that shall fall within its jurisdiction, as follows:

- a. The territorial jurisdiction shall cover Vema Seamount area and adjacent waters. Territorial jurisdiction shall include the Vema Seamount Airspace, in accordance with this Declaration.
- b. The jurisdiction shall encompass all powers and responsibilities as specified in this Declaration. This jurisdiction shall include internal security and public order.
- c. The jurisdiction shall extend to all persons within the territory.

Article 6: Powers and Responsibilities of the Capital House Administration
1. The Authority of the elected Prime Minister of Mount Vema herein the Veman Prime Minister shall consist of a Council of Ministers. The Veman Prime Minister or the Prime Minister of Mount Vema shall act in the name of the Veman Sovereign and shall carry out the responsibilities for the day-to-day administration of the country hereby established, in accordance with this Declaration.
2. Capital House, which shall be the name of the official residence and work place of the Prime Minister of Mount Vema, shall make public the names of the members of the Veman Congress, other Officials and any change of Government officials.
3. The Capital House Administration shall oversee the departments established or to be established within the State herein the Kingdom of Mount Vema.
4. Subject to the provisions of this Declaration, the Capital House Administration, within its jurisdiction:
7. Legislation promulgated by the Capital House Administration shall be consistent with the provisions of this Declaration.
8. Legislation promulgated by the Capital House Administration shall be communicated to the Veman Congress. The Capital House Administration shall not report to the Veman Congress of its internal district level legislations. However the Veman Congress may request the Administration to submit a copy of such document to the Congress if it believes that such legislation exceeds the jurisdiction of the Government or is otherwise inconsistent with the provisions of this Declaration.
9. Upon receipt of the Congress request, the Capital House Administration shall decide, as initial matter on the entry into force of the legislation pending its decision on the merits of the matter.
10. If the Capital House Administration believes the Legislation does not exceed the Government Authority or that the Legislation is consistent with provisions of this Declaration and the Veman Congress believes otherwise regard to the entry into force of the legislation. This issue shall be referred to the Mount Vema Royal House of Law for review.
11. Legislation referred to the House of Law for review shall enter into force only if the House of Law decides that it does not deal with security of the Kingdom of Mount Vema or seriously threaten other significant interests protected by this Declaration, and that the entry into force of the legislation shall not cause irreparable damage or harm to the Kingdom of Mount Vema, the planet Earth or the Vema Seamount marine life.
12. When reviewing legislation, the Capital House Administration shall attempt to reach a decision on the merits of the matter from the date of the Veman Congress request. If the House of Law is unable to reach such a decision within a period of 30 days, the matter shall be solved by the Veman Sovereign.
13. Where the legislation has not entered into force, this situation shall be maintained pending the decision of the Sovereign on the merits of the matter, unless it has been decided otherwise.

3. The Capital House Administration shall oversee the departments established or to be established within the State herein the Kingdom of Mount Vema.
4. Subject to the provisions of this Declaration, the Capital House Administration, within its jurisdiction:
- a. Shall have legislative powers as set out in this Declaration, as well as executive powers;
- b. Shall have, power to formulate policies, supervise their implementation, employ staff, establish departments, authorities and institutions, sue and be sued and conclude contracts.
- c. Shall have, power to keep and administer registers and records of the population, and issue certificates, licenses and documents as prescribed by the Veman Congress.
- a. In accordance with this Declaration, the Capital House Administration shall not have powers and responsibilities in the sphere of foreign relations; that includes the establishment abroad of embassies, consulates or other types of foreign missions or permitting their establishment in Mount Vema. The appointment of or admission of diplomats or consulates exercising diplomatic functions shall be the responsibility of the Monarchy of Mount Vema - Herein The Veman Sovereign - The Vema Seamount Authority.
- b. Notwithstanding the provisions of the above paragraph, the Capital House Administration may conduct negotiations and sign agreements with foreign corporations or international organizations for the benefit of the People of Mount Vema in the following cases only:
- b-1. commercial agreements, with foreign establishments, businesses and organizations;
- b-2. agreements with donor organizations for the purpose of implementing arrangements for the provision of assistance to the Kingdom of Mount Vema development programs;
- b-3. agreements for the purpose of implementing the Kingdom of Mount Vema international development commitments.
- b-4. cultural, scientific and educational agreements.
7. Legislation promulgated by the Capital House Administration shall be consistent with the provisions of this Declaration.

Article 7: The Security of Vema Seamount
In order to secure and guarantee the protection of the Kingdom of Mount Vema, the Monarchy of Mount Vema shall establish strong security services with capabilities for defense against external threats and for the purpose of safeguarding its internal security. It shall have all powers to take the steps necessary to meet this responsibility and use deadly force if necessary in self-defense.
Article 8: The Mount Vema Royal Guard
1. The Vema Seamount Authority shall establish a strong Law Enforcement Force (hereinafter "the Mount Vema Police" and a strong Defense Force, herein the ‘Mount Vema Military’). The duties, functions, structure, deployment and composition of the Mount Vema Royal Guards, together with the provisions regarding its equipment and operation, shall be published from time to time.
2. Except for the Mount Vema Police and its divisions referred to in this Article and the Mount Vema Military and its divisions, no other armed services shall be established or operate in Mount Vema.
3. Except for the arms, ammunition and equipment of the Mount Vema Police and those of the Mount Vema Military, no organization or individual in the Kingdom of Mount Vema shall manufacture, sell, acquire, possess, import without the consent of the Vema Seamount Authority or otherwise introduce into the Kingdom of Mount Vema any firearms, ammunition, weapons, explosives, gunpowder or any related equipment, unless otherwise provided for in this Declaration.

Article 9: Safe Passages
1. The Vema Seamount Authority shall be responsible for the borders, gates and the customs and immigration services of the Kingdom of Mount Vema. It shall issue permits to those visiting or working over Vema Seamount.
2. The international airport and seaport shall be under the control of The Vema Seamount Authority.
3. The Vema Seamount Authority shall ensure that no goods or people shall enter the Vema Seamount without the necessary permit.

Article 10: Relations between Mount Vema Establishments
1. Mount Vema Establishments shall seek to foster mutual understanding and tolerance and shall accordingly abstain from incitement, including hostile propaganda against each other and, without derogating from the principle of freedom of expression, shall take measures to prevent such incitement by any organization, groups or individuals within the Kingdom of Mount Vema.

Without derogating from other provisions of this Declaration, the Vema Seamount Authority and the Mount Vema Establishments shall co-operate in combating criminal activity which may affect the Kingdom of Mount Vema or the world at large, including offences related to trafficking in illegal drugs and substances, smuggling and offences against property.

Article 11: Trade and Economic Relations
The economic relations between the Kingdom of Mount Vema and its Trade Partners shall be governed by the relevant provisions of this Declaration, legislations, rules and treaties to be made.
Article 12: Human Rights and the Rule of Law
The Vema Seamount Authority shall exercise its powers and responsibilities, pursuant to this Declaration, with due regard to internationally accepted norms and principles of human rights and the rule of law.
Article 13: Transparency
1. The Monarchy of Mount Vema shall ensure the smooth implementation of the provisions of this Declaration.
2. The Monarchy shall allow international observer or environmentalists on its construction sites upon request.
3. The Kingdom of Mount Vema shall make public from time to time its findings and discoveries, the rules of procedures, including the frequency and place or places of its activities.

Article 14: Settlement of Differences and Disputes
1. Any difference or dispute relating to the acceptance of this Declaration shall be referred to the appropriate co-ordination and co-operation mechanism established under this Declaration.
2. Disputes arising out of the application or interpretation of this Declaration or any subsequent agreements relating to the Kingdom of Mount Vema - Vema Seamount shall be settled by negotiations through Mount Vema appointed officials.

Article 15: Prevention of Acts
The Vema Seamount Authority shall take all measures necessary in order to prevent acts of terrorism, crime and hostilities directed against the Kingdom of Mount Vema, the Kingdom of Mount Vema's properties, and against individuals failing under the Kingdom's authority, and shall take legal measures against offenders.
Article 16: Gestures of Goodwill
With a view to creating a positive and supportive atmosphere to accompany the effectiveness of this Declaration and to establish international co-operation, future work relations and a solid basis of trust and good faith, with other Nations of the Earth. The Vema Seamount Authority shall carry out confidence building measures as gestures of goodwill. It shall include apologies and compensations for any harm caused on the journey towards or during the creation of the Kingdom of Mount Vema - Vema Seamount and during the construction and establishment of the Settlement, on behalf of the Veman Sovereign, to any individual, institution or nation who may have incurred losses in the process.
Article 17: Rights, Liabilities and Obligations
The assumption and all powers and responsibilities of the Monarchy of Mount Vema, shall include all related rights, liabilities and obligations arising with regard to acts or omissions which occurred prior to the this Declaration. Any financial claim in this regard against the Vema Seamount shall be referred to the Vema Seamount Authority.
Article 18: Final Clauses
1. This Declaration entered into force on the date of its signing.
2. The Vema Seamount 200nm shall mark the territory and shall be authoritative only for the purpose of this Declaration.
3. Nothing in this Declaration shall prejudice or preempt the outcome of any other negotiations or the permanent status to be conducted pursuant to the Constitution of the State of Mount Vema.
4. The International Community and the Mount Vema Community shall view the Kingdom of Mount Vema - Vema Seamount as a Sovereign Territorial Kingdom, which integrity shall be preserved by the Monarchy of Mount Vema.
5. Vema Seamount and its adjacent waters shall be an integral part of the Kingdom of Mount Vema, and nothing in this Declaration shall be considered to change this status including the rights of ownership of the Monarchy of Mount Vema, and the Veman Sovereign supreme ruling rights and privileges.
